Terms of Service
1. Acceptance and Eligibility
These Terms form an agreement between you and CloudPost (“we,” “us,” or “our”) covering the CloudPost app and the services around it (the “Service”). Opening an account or using the app means you accept them. CloudPost is built for adults, and you should be 18 or older to create an account or use the Service; if you are under 18, you are not permitted to do so.
While setting up your profile, you may optionally enter your age. The app does not independently verify the age you enter, and it does not block access based on that field. An optional age entry is not an age check, and you are expected to answer honestly. We do not knowingly allow anyone under 13 to hold an account. If we learn that a user is under 18, or that a child under 13 has submitted details to us, we will take reasonable steps to remove that information and close the account.
2. Accounts
An account can be created with Sign in with Apple or with an email address and password. You are answerable for everything that happens under your account and for keeping your sign-in details safe. Sharing your account, or using someone else's without permission, is not allowed. Where we have reason to believe an account breaks these Terms or exposes the app or its users to harm, we may suspend or close it. You can close your account at any time from within the app; doing so removes the account and clears the local account data kept on that device, as further described in the Privacy Policy.
3. Fees and Purchases
CloudPost currently costs nothing to use, and this release contains no subscriptions or in-app purchases. If paid features are added later, the price and the conditions that apply will be shown before you buy. Anything purchased through the App Store also remains subject to Apple's own rules on billing, renewal, cancellation, and refunds.
4. User Content
Letters, replies, chat messages, photos, and profile material you submit are your “User Content,” and you keep ownership of it. For the app to work, you give us a royalty-free, non-exclusive right, valid everywhere, to store that material and to copy, transmit, show, and make technical adjustments to it whenever doing so is needed to run, safeguard, and support CloudPost, or to meet a legal requirement. You confirm that you hold the rights needed to post the material and that it does not trespass on anyone else's rights.
Material that is unlawful, harassing, hateful, sexually exploitative, threatening, defamatory, or otherwise harmful has no place on the app. Reporting and blocking are available inside CloudPost, and where we judge that these Terms have been breached, we may take content down or restrict an account. We do not promise to review everything, and we cannot guarantee that any particular material will stay available.
5. Prohibited Conduct
You agree not to:
- break any applicable law;
- harass, threaten, or cause harm to another person;
- pretend to be someone else or give a false impression of your identity;
- introduce malicious software or disrupt the Service;
- scrape, reverse engineer, or try to reach non-public parts of the app;
- send spam or unlawful advertising through CloudPost; or
- work around a block, suspension, or other enforcement decision.
6. Intellectual Property and Limited License
Everything that makes up CloudPost — its code, visual design, wording, artwork, and marks — belongs to us or to the people who license it to us, and is covered by intellectual-property protections. In return for your compliance with these Terms, you receive a personal, revocable, non-exclusive right to access the app for your own non-commercial use. That right cannot be transferred, and outside what the law permits, you may not reproduce, alter, resell, or rent out any part of the Service.
7. Third-Party Services
CloudPost relies on outside services, including Sign in with Apple and the App Store. Each of those operates under its own terms and privacy documents. Apple is not a party to this agreement and carries no duty to maintain or support CloudPost.
8. Geographic Availability
CloudPost is offered only to people located in the United States. If you are outside the United States, please do not open an account or use the Service. Should you access it from another country anyway, you act on your own initiative, and your details remain handled under these Terms and the laws that apply to you.
9. Disclaimer of Warranties
THE APP IS DELIVERED ON AN “AS IS” AND “AS AVAILABLE” FOOTING. WHEREVER THE LAW PERMITS, WE TURN ASIDE EVERY WARRANTY, SPOKEN OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A GIVEN PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. We do not promise uninterrupted, error-free, or secure operation, or that any letter will arrive by a set time.
10. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED, WE ARE NOT RESPONSIBLE FOR CONSEQUENTIAL, INCIDENTAL, PUNITIVE, SPECIAL, OR INDIRECT HARM, OR FOR LOST PROFITS, LOST DATA, OR DAMAGE TO REPUTATION, THAT CONNECTS IN ANY WAY TO YOUR USE OF CLOUDPOST. Where the law allows a cap on recovery, our combined exposure for all claims relating to the app is limited to the greater of the amounts you paid us in the year before the claim arose and USD 100. Because CloudPost is free, that figure will normally be USD 100. Some states do not allow these exclusions, in which case they apply to the maximum extent the law permits.
11. Indemnification
If a third party brings a claim against us because of material you posted, conduct you engaged in on CloudPost, or a breach by you of these Terms or of another person's rights, you will cover the resulting losses, including reasonable legal costs, and keep us harmless from them.
12. Governing Law
Delaware law controls these Terms and any question that arises out of them, without applying its rules on conflicts of law.
13. Dispute Resolution; Arbitration; Class Action Waiver
Most disagreements can be settled directly. Before filing anything, either side must send a written notice describing the issue and allow 30 days to work it out through good-faith discussions. If those talks do not resolve the matter, it goes to binding individual arbitration administered under the American Arbitration Association's Consumer Arbitration Rules, before a single arbitrator sitting in Wilmington, Delaware.
Each of us gives up the right to a jury trial and to starting or joining any class, group, consolidated, or representative proceeding; claims move forward on an individual basis only. Nothing here prevents either side from bringing a small-claims matter, asking a court for injunctive relief, or protecting intellectual-property rights. If a court finds part of this section unenforceable, the rest continues to apply.
You may reject this arbitration agreement within 30 days of first accepting these Terms by emailing cloudiosfeedback@cloudpostofc.com with a clear statement that you want to opt out. If you do not, you will be bound by it.
14. Changes to These Terms
When we revise these Terms, the updated version is posted through the same channel. Where a change is significant, we will flag it in the app or on the published page. Continuing to use CloudPost after the revision is in force signals that you accept it.
